​Terms and Conditions – Miss Rosie Weddings + Events “Miss Rosie”

  1. The signing of the Performance Agreement and receipt of Deposit funds (see performance agreement for deposit amount) shall constitute a binding agreement between the Client and Miss Rosie. Payment of the balance payable under the Performance Agreement is due as cleared funds in the Miss Rosie allocated Business Account/s up to seven (7) days prior to the Performance Date.
  2. Payment of the Fee shall be payable at least seven (7) clear business days into Miss Rosie allocated Business Account/s. Cheque payment is to be received at least two (2) weeks prior to the date of performance. If payment in full (cleared funds) has not been received within seven (7) clear days prior to the Performance Date (unless agreed otherwise in writing), Miss Rosie may terminate the Performance Agreement, with the deposit remaining payable.
  3. The Client may terminate the Performance Agreement at any time up to thirty (30) days prior to the date of the performance, with the deposit amount remaining payable. If the Performance Agreement is terminated by the Client at any time after thirty (30) days prior to the date of the performance, the full Fee shall become due and payable.
  4. Miss Rosie may terminate the Performance Agreement at any time up and/or during the Performance Call Period if they deem they are no longer able to supply an appropriate and effective service to the Client, due to any member of Miss Rosie experiencing abusive, negative, offensive, intimidating or threatening action or behaviour against them by either the Client and/or their guests, with the deposit to be refunded electronically to the client within three (3) business days of notice of termination of the Performance Agreement in writing by Miss Rosie.
  5. The Client acknowledges that a Standard Performance Fee is for all bookings within a one hour travel period from origin (3977), and that an extra fee may be incurred for any additional travel period required per member, per booking.
  6. The Client acknowledges that all bookings are for an evening / night Call Period, unless otherwise specified in the Performance Agreement.
  7. The Client further acknowledges that any additional services requested of Miss Rosie, not specified in the Performance Agreement may incur an additional Performance Fee.
  8. The Client shall ensure that sufficient accommodation is provided for each member for events greater than a two (2) and a half hour travel period from origin.
  9. The Client shall ensure that a designated and exclusive performance space satisfactory to Miss Rosie will be made available to Miss Rosie at the performance venue from the commencement of the Setup Period to the end of the performance by Miss Rosie, and at all times in between. The Client shall further ensure that after the Setup Period, no person, guest or member of the audience interferes with, handles, adjusts, changes or moves any equipment installed or placed in the performance space by Miss Rosie except with the consent of Miss Rosie, and shall not request or require Miss Rosie to move, adjust or change the position of its equipment after the Setup Period. The Client shall further ensure that Miss Rosie can pack up immediately after the Call Period, unless otherwise agreed by Miss Rosie
  10. The performance space shall be ideally at least 3 metres wide by 2 metres deep for a solo music, solo children’s entertainment or DJ booking, 4 metres wide by 3 metres deep for a duo music or duo children’s entertainment booking, 5 metres wide by 3 metres deep for a trio music or trio children’s entertainment booking and 6 metres wide and 4 metres deep for a four piece booking of any entertainment act type. The performance space shall be in a location in the performance venue that is reasonably proximate to electrical power points which shall be set aside for the exclusive use of Miss Rosie and any other reasonable requirements of Miss Rosie.
  11. Standard Production for Miss Rosie will cater for a function space and patronage of up to 200 people. Additional production requirements may incur an additional Performance Fee.
  12. If Miss Rosie, in their opinion considers the performance area unsuitable, unsafe or inappropriate, for any reason whatsoever including (but not limited to) inadequate electrical provision, the provision of sound limiting and or decibel level power cutting equipment, lack of appropriate shelter from inclement weather including rain, sun, sleet, snow, wind or extreme temperature, an unstable, dangerous or inappropriate work platform, inappropriate conduct of the audience and/or lack of appropriate supervision from venue staff or security, Miss Rosie is entitled to refuse to perform or (if the performance has commenced) cease the performance and shall not be obliged to perform or continue performance unless the situation is remedied to the satisfaction of Miss Rosie, the Fee remaining payable.
  13. The Client shall ensure that all laws, regulations, licenses (including liquor licenses), by - laws, agreement and similar matters relating to or affecting the performance venue and the function are complied with at all times by the Client and all employees, agents, contractors, guests, invitees, customers and patrons of and to the Client. Failure to do so shall entitle Miss Rosie to terminate the performance in which case the full Fee shall be payable.
  14. If the Setup Period changes after execution of the Performance Agreement, but prior to the date of performance, an extra fee will apply for any additional time spent by Miss Rosie between the Setup Period and the Call Period. Unless otherwise agreed, the Setup Period shall not be more than 3 hours prior to the Call Period.
  15. A small secure space shall be provided for costume change, make up and hair provisions for Miss Rosie during the Setup Period and Call Period, and the Client shall ensure that drinking water is made available to Miss Rosie during the Setup Period and Call Period at no charge to Miss Rosie.
  16. Suitable parking is to be provided for each member attending the event, within reasonable proximity of the performance space, and is to be free of charge to Miss Rosie.  If venue parking attracts a charge, the client is responsible for covering this charge.
  17. The Client indemnifies Miss Rosie in respect of any loss, damage or costs suffered or caused by reason of the Client’s failure to comply with any of these terms and conditions, the conduct of the audience or any other person at the function or any other matter whatsoever not caused directly by Miss Rosie or conduct of Miss Rosie.
  18. Miss Rosie reserves the right to provide a replacement act or act performer in the event that Miss Rosie or Act Performer is unable to perform on the night of the performance.
  19. If the performance time is delayed, extended or commences later than the Call Period as stipulated in the Performance Agreement including for reasons including (but not limited to) such as extended formalities and/or speeches, delays and/or changes in the meal service times, then the client acknowledges that that this may result in a reduction of sets and/or set playing periods by Miss Rosie and/or an increase of the Fee payable by the Client if the Call Period increases, at the discretion of Miss Rosie.
  20. Still photography, video photography and/or radio recording devices used during the performance period shall only be permitted for private use, unless prior written consent is provided by Miss Rosie. Miss Rosie may use still and video photography from your booking of either the venue, individual, group, crowd or distance shots, or of Miss Rosie for promotional reasons, including but not limited to the world wide web, social media, direct promotion etc. The Client may notify Miss Rosie at any time from the signing of the Performance Agreement if they object to promotional photography use in this manner.
